ATV Speed Restrictions

The use of four-wheelers has expanded far beyond recreational or leisure applications. These smaller vehicles are perfectly suited to navigate otherwise dangerous terrain that could prove prohibitively hazardous for full-sized SUVs or jeeps. Additionally, ATVs can help farmers and ranchers get around their property quickly and safely. However, there are many limitations placed on these vehicles by state and local laws, especially in terms of their speed. In the state of Wisconsin, the law states that ATV speed must be reduced significantly in various situations.

The law in Wisconsin sets up several scenarios when a four-wheeler operator must cut back on their speed significantly. According to the law, when an ATV approaches an area where they may come in contact with pedestrians or motorists, the speed must be lowered to 10 miles-per-hour. In addition to this specific reduction, most ATV trails and routes have clearly posted speed limits, which must be obeyed similar to public road limit postings.

According to the Wisconsin state laws, coming within 150 feet of a residential area requires an ATV operator to bring down their vehicle to this 10 mile-per-hour pace. This includes any form of home or dwelling, meaning that ATV use on trails around lake houses needs to be carefully handled. In addition, a four-wheeler driver needs to slow their vehicle within 100 feet of an ice fishing shack.

In addition to residential requirements, any time an ATV comes within 100 feet of a person not on a motorized vehicle, they should slow to 10 miles per hour. Among the different types of pedestrians, this includes individuals out for hunting or fishing, on horseback, bicycling, and hikers.

Failure to follow these speed restriction laws can result in serious injury to those struck by a four-wheeler. To learn more about your rights and options if you have sustained an injury from one of these vehicles, contact the Madison auto accident lawyers of Habush, Habush & Rottier, S.C., today.
