How to Terminate Legal Representation
- 1). Draft a disengagement letter. A disengagement letter is a statement of intent to terminate the attorney-client relationship. If you're the client, clearly state that you no longer want the attorney to represent you. If you're the attorney, your letter should include the reasons for termination, a brief statement of work done up to the point of termination and a bill for an outstanding fees.
- 2). Settle all accounts due. If you're the client, you must fully pay your attorney for services rendered up to the point of termination. If you're the attorney, you must return all unused advanced funds to the client.
- 3). The client should get her files back but only after she has paid the attorney fully for his work. Private client information, such as deeds or titles, must be returned to the client immediately, regardless of any fee dispute.
