If you are driving under influence, the state of your residence will assume that you have a drinking problem. There are also mandates on evaluation of alcohol, treatment and education before the driving privileges of the person are restored.

Per Search engines Laws: All the US states now have 'per search engines' 0.08 BAC or blood alcohol concentration laws. This means that if the drunken driver has a 0.08 or higher BAC, it is evidence of the fact that the driver was intoxicated while they were driving. Generally, the states mention that if anyone is accused of drunken driving, they should undergo a test for determining the extent of alcohol consumption they are going through. This means that if anyone is convicted of drunken driving, that very fact substantiates the point that the driver suffers from a problem drinking syndrome, according to the legislative requirements of the state concerned.

Alcohol Evaluation: Before the convicted driver gets their privileges returned, most of the states require them to go through an evaluation for determining the extent to which their lives have been affected by the consumption of alcohol. If the behavior of their drinking is taken to be abuse of alcohol, or dependence on alcohol, adequate measures are taken. In a lot of states, the DUI offenders are interviewed by a certified drug and alcohol counselor. They are asked several questions to understand if the offender needs to be adequately educated.

Alcohol Education: In most states, drunk drivers that are convicted of DUI are made to take part in classes which educate them on the dangers of drunk driving or driving while they are impaired. At times, these schools are known as drunk driving schools or DUI schools. If the evaluation is tested positive, the driver is made to attend more of the education classes.

Treatment of Alcohol Abuse: In case the tests of the evaluation are positive, certain states require the driver to go through additional classes to complete treatment methods before they receive their driving privileges. If there is indeed a drinking problem, the states need the problem to be addressed before the driver can be legally returned to the highway. The treatment depends on the reports of the evaluation and includes support group meets, therapy sessions, outpatient counseling, residential rehab or inpatient detoxification. The aim of the treatment is to make the offenders aware that driving under influence renders a problem for society.
