Justice for Travvon Martin in Civil Court
The Civil Courthouse may be the only place that Trayvon Martin and his family will find justice, just as in the Nicole Brown vs. OJ. Simpson case. The killing of Trayvon Martin is a sign of our times in Florida. Homeowners associations, apartment owners, condominium associations and even trustees for foreclosed and bankrupt properties are faced with ever increasing crime rates and a legal duty to provide reasonable protection to their residents. In the face of these increased threats to their residents, land owners have either ignored the problem or increased the risks by not hiring professional security personnel. In late August the homeowners association decided to create a neighborhood watch program and they chose George Zimmerman to head the endeavor. Did they do a background check on George Zimmerman? Did they hire or ask any security companies to evaluate their security needs and provide them with professional advice? Did they get a copy of the "criminal grid" which is usually available at the local police or sheriff' department? Did they instruct George Zimmerman not to carry a gun? Did they train George Zimmerman? These are just a few of the questions that will need to be answered as attempts are made to determine Retreat at Twin Lakes' liability.
George Zimmerman was appointed by the homeowners association as the head of their crime watch and he was acting on their behalf when he shot and killed Trayvon Martin. In the author's opinion this will make the Retreat at Twin Lakes liable for Trayvon Martin's death and provide some justice to his family. The burden of proof in civil courts is lower than in the criminal courts. This may mean that justice will only be found in the civil court house for Trayvon Martin and his family. Therefore, it will be important for the family to secure the efforts of an experienced Miami personal injury lawyer that can actively work to seek justice on behalf of the fatality accident victim in either the criminal courts or the civil courts. The Travvon Martin case is one that has been reflected in similar past cases and will likely manifest in similar ways again. Therefore, it will be important to ensure that the case is handled with care, as it could set a precedent for further cases in the future
