Hearsay Defined

  • Hearsay is an out of court statement made by a person other than the one testifying to the statement. Because the original maker of the statement is not present to testify to the statement in court, and have his credibility tested, these statements are inadmissible. However, within the rules of evidence there are two-dozen exceptions to the rule and even if a statement fails to fit into one of these exceptions, rule 807, the residual exception, may admit the statement.

Rule 807: Residual Exception

  • Rule 807 allows the entry of statements that are not covered by any other exceptions if the statement bears sufficient guarantees of trustworthiness, is relevant and justice would be served by admitting the statement.

Purpose of Rule 807

  • The purpose of rule 807 is obvious on its face: allow potentially valuable hearsay to be entered when such statements would have otherwise been excluded.
