Nova-Scotia Liquor License Act

104 41

    Types

    • Section 48 of the act outlines which businesses may obtain a liquor license and what kinds of alcohol each type of licensee is permitted to serve. For example, a club license allows you to have and dispense liquor, but a tavern license only permits the sale of beer by the glass or open bottle. There are eight different classes of liquor licenses you can apply for.

    Eligibility

    • There are certain criteria you must meet in order to get a liquor license. Section 8 of the regulations states that you have to either own or lease your business or have an option to own or lease. Second, the review board has to assess whether giving your business a license to serve alcohol will interfere with the quietness of other establishments, such as other businesses, schools, churches or hospitals.

    Service Hours

    • With the exception of a cabaret license, the regulations stipulate that the latest time a licensed business is authorized to sell or dispense liquor is 2 a.m. A cabaret business, however, is permitted to sell or distribute liquor until 3:30 a.m. You may apply for a temporary extension if you wish to extend these time frames. An extension is granted by the Minister of Labor and Workforce Development.

    Price

    • You are not permitted to sell a serving of liquor for less than what it cost you to purchase it, according to the regulations. Liquor is categorized by volume and type. For example, 12 oz. of beer, cider or coolers or 5 oz. of wine is considered a serving. If you sell liquor that is a different volume or size than that prescribed in the regulation, you'll have to increase or decrease the price accordingly.

    Utility and Review Board

    • The ultimate decision on liquor licenses is made by the board. You must submit an application to the licensing division of the Alcohol and Gaming Division (AGD) with details of your business, including zoning clearances, floor plans, a deed or lease. If you're applying for a license for a lounge or club, there will usually be a public hearing.
