If you live in a neighborhood with a HOA, or Homeowner's Association, then you agree to follow the rules of the community. Some Homeowner's Associations are helpful and in place as a resource for residents, whereas others can cause frustration. There are situations where you may have to go against the HOA. They can put liens on your home, assess fines, and cause general problems within your community. If you find yourself in that scenario, here are some tips on how to fight your HOA and win.

Make sure you have all the records on how you have abided by the rules of the HOA. For instance, if there is a dispute on if you have paid your Homeowner's dues, gather all the records of payment to the HOA. If you have a situation where you have done something against the rules of the HOA, but have gained special permission from the HOA, make sure to have the information on who granted the exception, the date it was granted, and anything you find that is relevant. Copies of email's or records of phone calls are important items to add. If you have a copy of your HOA guidelines, make sure to find exactly where the rules that pertain to the issue are located. To fight your HOA, you will need to be well prepared.

Write a letter to the agency in your state that regulates HOA's. Include copies of all the records that you have gathered, including the name of your subdivision and the names of the people on the board of your HOA. Mail the letter via certified mail to the HOA as well as to the state agency. Keep the records of when you mailed the letters as well as the receipt of the certified postage.

Once the state has received your letter, you will have a record of action. As long as you have followed all the rules set forth, or can show that you were told you did not have to, the HOA will not be able to levy any punishments such as fines or liens on your home.
