- 1). Complete credit counseling from an agency approved for pre-bankruptcy counseling. Find an agency by contacting a Consumer Credit Counseling Service office in your area. Look for a number in your telephone directory.
- 2). Obtain written certification from the Consumer Credit Counseling Service that you successfully completed credit counseling for filing a Chapter 13 bankruptcy petition.
- 3). Get the necessary legal forms for filing for Chapter 13 bankruptcy. These forms cannot be obtained from the courts, according to the United States Bankruptcy Court Middle District of Florida, but they are available from Florida office supply stores or legal stationery stores.
- 4). Fill out the forms according to instructions. List all of your debts, and also include a listing of your assets, such as real estate and money in retirement accounts.
- 5). Contact the Administrative Office of the U.S. Courts at 202-502-2600 to ask where you should file your bankruptcy petition in Florida, or check the U.S. Courts website.
- 6). Visit the bankruptcy court and find the court clerk's office. Tell a representative you wish to file a petition for Chapter 13 bankruptcy. Present your completed paperwork and pay the fee, which was $299 as of 2010. Once you make the payment, your petition will be filed with the court.
