A federal appellate court has upheld a judge's ban on sections of the SB1070 Arizona law.

On Monday, a panel of three judges of the U.S. 9th Circuit Court of Appeals agreed with the federal judge in Arizona who placed a ban on the most controversial provisions of the immigration law under the belief that the bill was an "unconstitutional intrusion into immigration and foreign policy."

The bill was introduced last year by Gov. Jan Brewer after frustrations over illegal immigration came to a boil. Those who oppose the bill argue that it creates racial profiling and is discriminatory but Gov. Brewer argues that it is a solution to a problem that the federal government has done nothing to fix.

One judge, however, argued in favor of the provision which allows police officers to question the status of people they stop in routine traffic violations if they suspect them to illegally staying in the country. Yet, the provision did not pass with the majority and was shut down.

Gov. Brewer and Arizona Attorney General Tom Horne issued a statement criticizing the ruling. However, they did not mention whether or not they would appeal the ruling to a full panel of the 9th Circuit or to the Supreme Court.

"I remain steadfast in my belief that Arizona and other states have a sovereign right and obligation to protect their citizens and enforce immigration law in accordance with federal statute," Brewer said.
